One of the Court's most activist eras occurred during the period from 1953 to 1969 under the leadership of Chief Justice Earl Warren. The Warren Court propelled the civil rights movement forward by holding that laws permitting racial segregation violated the equal protection clause.

Liberal Activism - The term judicial activism has often been linked with liberalism. Many liberals are in favor of an activist federal judiciary because they believe that the judiciary can "right" the "wrongs" that result from antiquated legislation at the state and  local levels.

Conservative Restraint - Judicial restrain is often associated with conservative justices and courts. Today's Rehnquist Court is said to often exercise judicial restraint as in 1997 when they voted to uphold the constitutionality of state laws prohibiting assisted suicide.

If your were a Supreme Court justice, would you ever overturn a law passed by an elective body, such as Congress, which, at least in theory represents the interests of the majority of American citizens?

After careful study of the scenario above, review the textbook, your notes, and use the WWW Search feature of this Web to construct your best answer. After serious reflection and critical thought, go to your Word Processor and type a three page  response. When satisfied that your response represents your best legal and ethical views, Select and copy your text and click on the "Go To Threaded Discussion" button below and Paste your response there. Post as a "NEW TOPIC" to the appropriate assignment forum.
