THE YOUTH VIOLENCE CASE STUDY - PART ONE

Last month, the Department of Justice released a report indicating that violent crime by juveniles increased 54% in Tampa between 1994 and 1998. In addition, there was recently an incident at Tampa High School in which one alleged gang member shot another and killed him. As a result, your constituents want you to do something about youth violence.

One of your advisors suggests that you consider imposing a curfew on people younger than 18 years old. Under this plan, minors would not be permitted to be in public between the hours of 11:00 p.m. and 5:00 a.m. without an adult. Your advisor argues that children have no business being out that late at night, particularly during the week. He argues that they should be home studying or sleeping. In addition, he reports that when the city of Orlando adopted a similar curfew, juvenile crime decreased by 14%.

However, the American Civil Liberties Union (ACLU) says that it will sue the city of Tampa if you impose this curfew. They claim that the curfew amounts to illegal discrimination based on age.

What will you do?
